Prosecutors want Nacchio in court for new sentence

DENVER — Federal prosecutors are objecting to former Qwest CEO Joe Nacchio's request to not be present in court when he is given a new sentence.

The U.S. attorney's office said in a court filing Monday that Nacchio should be required to appear at the sentencing hearing to promote respect for the law and so he can "personally receive the official expression of the condemnation of his conduct." The hearing is scheduled for June in Denver.

Nacchio is serving a six-year prison term after being convicted on insider trading charges. A federal appeals court last year ruled the sentence was too harsh because the trial judge miscalculated Nacchio's gains.

Nacchio's attorneys said in a court filing earlier this month that he was waiving his right to appear in court for the new sentencing hearing.
