Nacchio's surrender date postponed

A Denver federal judge today granted former Qwest chief executive Joe Nacchio's request to delay the date he must surrender to authorities to begin serving a six-year prison term for illegal insider trading.

U.S. District Judge Marcia Krieger postponed the date, scheduled for Monday, indefinitely until she rules on Nacchio's request for bail pending a Supreme Court review of his conviction.

The order is contingent on Nacchio filing on Friday a petition to the Supreme Court and a request for bail pending the the high court review with Krieger.

It's possible that Krieger could rule on the bail request Friday and order Nacchio to report to prison on Monday as scheduled, though she indicated during a court hearing today that she wanted to have sufficient time to review the bail request.  Also today, Nacchio's attorney disclosed that his biopsy came back negative and the "suspicious growth" on his leg is benign.

Nacchio had sought to delay the surrender date to receive medical treatment for the growth.

Nacchio was not at the hearing.  Court filings connected to his medical condition suggest he is spending his time in Florida.
